Stock firm sued for husband's loss ( 2003-09-04 13:39) (China Daily)
A woman who sued a stock trading firm for allowing her husband to transfer money from an account opened in her name has failed to win compensation, reports New Express News. Tu, who opened the account with the firm in 1999, discovered some 430,000 yuan (US$51,800) missing in March, 2002. Account records showed that the money had been withdrawn by her husband, Peng. Peng had authorized himself to use the account by presenting the couple's marriage certificate, Tu's identity papers and other documents to the firm without her knowledge. Tu ordered Peng to return the money within three months to no avail. The frustrated woman then hauled the stock trading firm to court. But the Guangzhou Yuexiu District People's Court denied her request for compensation, because "the firm had not caused any loss to the couple". Tu did not stipulate to the stock trading firm beforehand that the stocks were not the couple's common property, the judge said
