iPad“商標侵權”案

一個 iPad 商標，引發了一場知識產權的血戰，也引發了網友的圍觀。蘋果公司在與唯冠科技(深圳)有限公司的商標侵權案中一審判決敗訴，唯冠申請禁售令，蘋果公司iPad在中國各地的專賣店遭遇下架。

Trademark infringement就是指“商標侵權”，是指行為人未經商標權人許可，在相同或類似商品上使用與其 trademark registration(注冊商標)相同或近似的商標，或者干涉、妨礙商標權人使用其注冊商標，損害商標權人legitimate interest(合法權益)的其他行為。行為人銷售明知或應知是counterfeit registered trademark(假冒注冊商標)的商品, right to exclusive use of trademark(商標專用權)被侵權的natural person(自然人)或者legal entity(法人)在civil affairs(民事)上有權要求侵權人cessation of infringement(停止侵害)、eliminate ill effects(消除影響)、redress damage(賠償損失)。
