7. Prohibited and restricted articles and types

Prohibited and restricted articles are the short form for articles that the country prohibits from entering or exiting the territory and articles that the country restricts from entering or exiting the territory. Articles prohibited from entering and exiting the territory refer to the articles that the government expressly prohibits entering or exiting the territory through laws and regulations in order to protect the political, economic, cultural, moral and health interests. Articles restricted from entering and exiting the territory refers to the articles that the value and quantity are limited in entering and exiting the territory according to the state regulations or articles that may enter or exit the territory upon approval of the relevant departments.

In accordance with the provisions of relevant Chinese laws and regulations, articles prohibited from entering the territory include: (1) Weapons, simulated weapons, ammunition and explosives of all kinds; (2) Counterfeit currencies and counterfeit negotiable securities; (3) Prints, films, photographs, gramophone records, cinematographic films, loaded recording tapes and video-tapes, laser discs, computer storage media, gambling chips and other articles which are detrimental to the political, economic, cultural and moral interests of China; (4) Deadly poisons of all kinds; (5) Opium, morphine, heroin, marijuana and other addiction-inducing drugs and psychedelics: (6) Animals, plants and products thereof infected with or carrying disease germs, insect pests and other harmful organisms; and (7) Foodstuff, medicines and other articles coming from epidemic-stricken areas and harmful to man and livestock or those capable of spreading diseases.

Articles prohibited from exiting the territory include: (1) All the articles listed in the scope of articles prohibited from entering the territory; (2) Manuscript, prints, films, photographs, music, videos, audio tapes, video tapes, laser discs, computer storage media, gambling chips and other articles involving state secrets; (3) Precious relics and other relics prohibited from exiting the territory; (4) endangered and rare animals and plants (including specimens) and their seeds and propagating material.

Articles restricted from entering the territory include: (1) Radio transceiver and communications secrecy machine; (2) tobacco and alcohol; (3) Endangered and rare animals and plants (including specimens) and their seeds and propagating material; (4) National currency; and (5) Other articles that are restricted from entering the country by the customs such as microorganisms, biological products, blood and blood products, human genetic resources, controlled knives, and satellite television receiving equipment.

Articles restricted from exiting the territory include: (1) Gold and silver and other precious metals and their products; (2) National currency; (3) Foreign currency and negotiable securities; (4) Radio transceiver and communications secrecy machine; (5) Precious Chinese herbal medicine; (6) General relics; (7) Other articles that are restricted from exiting the country by the customs such as microorganisms, biological products, blood and blood products, human genetic resources, controlled knives, and satellite television receiving equipment.

8. Primary punishments and compulsory measures for foreigners violating Chinese exit-entry laws and regulations

(1) Deportation. The people's court may impose separately the punishment of deportation or additionally to other punishment on foreigners committed crimes in China. For foreigners who seriously violated the exit and entry administration law, the Ministry of Public Security can decide to deport them. Deported foreigners shall not be allowed to enter China within 10 years calculating from the date of deportation.

(2) Exit within a prescribed time limit. Where foreigners engage in activities not corresponding to the purposes of stay or residence, or otherwise violate the laws or regulations of China, which makes them no longer eligible to stay or reside in China, they may be ordered to exit China within a time limit.

(3) Repatriation. Foreigners (1) are ordered to exit China within a prescribed time limit but fail to do so; (2) are involved in circumstances in which they are not allowed to enter China; and (3) illegally reside or work in China. Repatriated persons shall not be allowed to enter China for one to five years.
