Administrative Measures for the Registration of Production and Business Operation Conducted by Enterprises of Foreign Countries (Regions) within the Territory of China (Issued by the Order No 10 of the State Administration for Industry and Commerce on August 15, 1992)
Eligibility requirements:
1. According to Chinese laws and regulations in force, foreign enterprises shall apply for registration if they are engaged in the following production and business:
1) Exploration and exploitation of onshore and offshore oil and other mineral resources;
2) Contract projects for construction and decoration of houses and civil engineering, or installation of circuits, pipelines and equipment;
3) Operation and management of foreign-invested enterprises by contracts or authorization;
4) Branches established in China by foreign banks;
5) Other production and business permitted by the State.
2. For those involving approval items, the enterprises shall submit effective approval documents or licenses.
Charging standard and legal basis:
Legal basis: Regulations on charging standards and scopes of company registration
Charging standards:
1) Those related to contract projects in China: based on the contract value and charging standard of registration of foreign-funded enterprises;
2) Those related to operation and management by contracts or authorization: five percent of the total management fee;
3) Those related to cooperative exploitation of marine oil: at the exploration or exploitation stage - 2,000 yuan, at the production stage – base on the charging standard of registration of foreign-funded enterprises;
4) Those related to cooperative exploitation of marine oil by contracts: based on the contract value and charging standard of registration of foreign-funded enterprises;
5) Those establishing branches in China: based on the charging standard of registration of foreign-funded enterprises.
